National Limited Lifetime Warranty

1. Warranty Period
This warranty begins on the date your repairs are completed and ends when you no longer own the repaired vehicle or it is written off.

2. Coverage
We will repair or replace any parts we repaired or replaced (the "Warranted Parts") that are defective due to improper workmanship or defective paint (including clear and primer), without charge for parts or labor. This warranty applies for as long as you own the repaired vehicle.

3. Exclusions
This warranty does not cover repairs needed due to:

- Unauthorized service or parts.

- Improper or inadequate vehicle maintenance.

- Use for which parts or accessories were not designed or approved.

- Alterations, accidents, modification of repairs, and repairs performed by any party other than an AutoCanada Collision Centre after the warranty begins.

- Paint deterioration caused by bubbles, blisters, or other film degradation due to rust or corrosion from the base coat.

- Hazing, chalking, oxidizing, or loss of gloss caused by improper care, abrasive polishes, cleaning agents, heavy-duty pressure washing, or any other product and/or abusive operation.

- Scratches, chips, or stone bruises due to normal vehicle use. Commercial use—finishes on vehicles used for commercial or competitive purposes.

- Damage caused by abuse, misuse, neglect, accidents, vandalism, acid rain, chemical fallout, hail, tree sap, road salt, sand, rocks, pebbles, windstorms, sun, pollution, or other environmental factors, acts of nature, or road hazards that may damage cloth, leather, plastic, wood, vinyl, paint, chrome, upholstery, and/or convertible tops.

Parts supplied by third-party manufacturers are excluded from this warranty and are only covered by warranties, if any, supplied by such third-party manufacturers.

4. Authorized Repairs
All repairs under this warranty must be performed by us or another AutoCanada Collision Centre and must be approved by an AutoCanada Collision Centre manager before you authorize further repairs to your vehicle. Any work not pre-approved is not covered.

5. No Replacement Vehicle Coverage
This warranty does not cover repairs to a replacement vehicle or reimburse you for repairs completed by another collision centre.

6. Determination of Coverage
We have sole discretion to determine whether coverage applies to Warranted Parts, in accordance with the terms of this warranty.

7. Discovery of Claim for Warranty
If you find a failure of any Warranted Parts, you must promptly notify us, prevent further vehicle damage, and take reasonable steps to secure timely repairs by:

- Returning to our location or another AutoCanada Collision Centre.
- Permitting a representative to inspect the Warranted Part.
- Presenting the original warranty certificate.

Failure to do so may void coverage or result in a deductible that you must pay, in an amount we reasonably determine.

8. Requests for Information
We may request documentation or other information to evaluate claims for coverage. Your refusal or failure to provide this information in a timely manner may void coverage.

9. Waiver of Rights
You waive your right to the return of any replaced auto parts, which become the property of the AutoCanada Collision Centre performing the warranty work.

10. Disputes
Any disputes related to this warranty will be resolved through mediation. If the matter is not settled by mediation, it will be resolved by binding arbitration in accordance with the applicable provincial legislation in the province where we are located. The arbitration claim must be on an individual basis only, not as a class action or in a representative capacity.

11. Assignment
This warranty is not assignable or transferable by you. It is assignable by us without notice, and after assignment, we are released of all liability to you.

12. Limitation of Liability
We are not liable for any consequential, special, indirect, incidental, punitive, or exemplary loss, damage, or expense, or any loss of revenue or profit, or any other commercial or economic loss or failure to realize expected savings, regardless of whether we have been advised of the possibility of such damages.

13. Entire Agreement
This warranty is the only warranty for repairs by us and supersedes all other warranties and representations, whether written or oral. No other warranties are made with respect to repairs performed by us. You acknowledge that you have not been induced to authorize repairs by any representation or warranty not set forth in this warranty. This warranty constitutes the entire agreement between you and us regarding its subject matter and supersedes any existing agreements and all other oral or written communications concerning its subject matter. This warranty may only be modified in writing, signed by you and us.

14. Governing Law
This warranty is governed by the laws of the province where our collision centre is located and the laws of Canada applicable in that province.

15. Severability
If any provision of this warranty is found to be unenforceable, that provision shall not affect the other provisions, but the unenforceable provision shall be modified to the extent necessary to render it enforceable, preserving to the fullest extent permissible the intent set forth herein.
